FITCHBURG MAN SENTENCED TO 46 MONTHS FOR ILLEGAL FIREARM SALE
BOSTON, Mass. - A Fitchburg man was sentenced today in federal court for being a felon in possession of a firearm in connection with the illegal sale of a firearm.
BRIAN CHANTHACHACK, 25, of Fitchburg, was sentenced by U.S. District Judge F. Dennis Saylor to 46 months imprisonment, to be followed by 3 years of supervised release after pleading guilty to one charge of being a Felon in Possession of a Firearm on June 11, 2010.
At the earlier plea hearing, the prosecutor told the Court that had the case proceeded to trial the Government’s evidence would have proven that the investigation and arrest of CHANTHACHACK was part of a large scale undercover operation investigating drug and gang activity in Fitchburg that resulted in 10 federal indictments and the prosecution of over 20 individuals on state charges. On August 28, 2008, a witness (“CW”) assisting law enforcement officers made arrangements to purchase a firearm from CHANTHACHACK. The two met in Fitchburg, and drove to a residence on Payson Street where CHANTHACHACK entered and returned with a Thompson Arms 7mm handgun. CHANTHACHACK and the CW then drove to an apartment on Clinton Street where CHANTAHCHACK was paid $160.00 for the firearm. There CHANTHACHACK was videotaped discussing the possibility of future firearm sales. During the course of this exchange, CHANTHACHACK and the CW are recorded loading and pretending to shoot the weapon with CHANTHACHACK stating, “that’s a one shot kill...that’s personal.”
United States Attorney Carmen M. Ortiz, Steven W. Derr, Special Agent in Charge of the Drug Enforcement Administration, Boston Field Division, Richard DesLauriers, Special Agent in Charge of the Federal Bureau of Investigation, Boston Field Division and Colonel Marian McGovern, Superintendent of the Massachusetts State Police made the announcement today. The case was investigated by the DEA HIDTA, which includes the Federal Bureau of Investigation and Massachusetts State Police. The case was prosecuted by Assistant U.S. Attorneys Karen Bell and Mark Grady of Ortiz’s Worcester Branch Office.
