Boston, MA... A Haverhill man was convicted yesterday in federal court on a firearms and ammunition charge.

United States Attorney Carmen M. Ortiz; Glenn N. Anderson, Special Agent in Charge of the Bureau of Alcohol, Tobacco, Firearms and Explosives - Boston Field Division; and Chief Alan R. DeNaro of the Haverhill Police Department, announced today that PEDRO NUNEZ, age 29, of Haverhill, Massachusetts, was found guilty after a four day jury trial held before U.S. District Court Judge George A. O'Toole, Jr., of being a Felon in Possession of a Firearm.

The evidence proved that in the early morning hours on or about July 20, 2008, NUNEZ fired a firearm outside of the Cordovan Apartment Complex in Haverhill, Massachusetts while in the presence of two other individuals. He was apprehended a short time later in close proximity to the apartment complex. That same evening, a .38 caliber Colt revolver was recovered by police approximately one block away from the apartment complex. The evidence also proved that while inside of the police cruiser that evening, NUNEZ discarded 12 pieces of ammunition and a speed loader. The evidence further showed that the defendant has previously been convicted of crime(s) punishable by more than one year imprisonment.

Judge O'Toole has scheduled sentencing for May 25, 2010. As an armed career criminal, NUNEZ faces a mandatory minimum sentence of 15 years in prison on the charge.

The case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Haverhill Police Department. The case is being prosecuted by Assistant U.S. Attorneys Suzanne Sullivan and Christopher Pohl in Ortiz's Organized Crime Strike Force Unit.
