MARVIN ELCID MONTES-CERRATO INDICTED FOR ILLEGAL USE OF A SOCIAL SECURITY NUMBER
MARVIN ELCID MONTES-CERRATO, age 36, a citizen of Honduras who is unlawfully present in the United States, was charged today in a one-count indictment by a Federal Grand Jury for illegal use of a Social Security number, announced U. S. Attorney Jim Letten.
According to the indictment, on or about July 23, 2009, MONTES falsely represented that a Social Security number had been assigned to him by the Commissioner of Social Security with intent to deceive, for the purpose of obtaining a Louisiana driver’s license.
If convicted for illegal use of a Social Security number, MONTES faces a maximum term of imprisonment of five (5) years, a fine of $250,000.00 and three (3) years of supervised release following any term of imprisonment.
U. S. Attorney Letten reiterated that the indictment is merely a charge and that the guilt of the defendants must be proven beyond a reasonable doubt.
The case was investigated by U. S. Immigration and Customs Enforcement (ICE) - Enforcement and Removal Operations and the Jefferson Parish Sheriff’s Office as part of the Criminal Alien Removal Initiative. The case is being prosecuted by Special Assistant U. S. Attorney Robert Weir.
