ILLEGAL ALIEN SENTENCED FOR MAKING FALSE STATEMENTS TO A FEDERAL AGENCY
NESTOR ALEJANDRO GONZALEZ-BAUTISTA, age 27, a citizen of Mexico, was sentenced yesterday in federal court by U. S. District Judge Jay C. Zainey to approximately four months imprisonment, announced U. S. Attorney Jim Letten. In addition to the term of imprisonment, Judge Zainey ordered that GONZALEZ be placed on two years of supervised release following the term of imprisonment, during which time the defendant will be under federal supervision and risks an additional term of imprisonment should he violate any terms of his supervised release.
According to court documents, on July 7, 2011, GONZALEZ pled guilty to making a false writing and document containing materially false statements and entries in that he prepared a written form on February 18, 2010 as part of his application for Transportation Worker Identification Credentials (TWIC), and signed that form, certifying and stating that he was a citizen or national of the United States, and therefore, met the requirements for issuance of a TWIC card, when in fact, he knew he was not a citizen or national of the United States and was unlawfully present in the United States, and he did not satisfy the requirements for issuance of a TWIC card, all in a matter within the jurisdiction of the Transportation Security Administration.
The case was investigated by the U. S. Department of Homeland Security, Homeland Security Investigations (HSI). The case was prosecuted by Special Assistant U. S. Attorney Robert Weir.
