ILLEGAL ALIEN CHARGED WITH POSSESSION OF A FIREARM

ELIAS GUEVARA, age 28, a citizen of Honduras, was charged in a criminal complaint today with being an illegal alien in possession of a firearm, announced U. S. Attorney Jim Letten.

According to the criminal complaint, in March 2010, GUEVARA, an illegal immigrant from Honduras, possessed a Remington,.22 caliber rifle, and attempted to exported it to Honduras through a local shipping company.

If convicted, defendant faces a maximum term of imprisonment of ten (10) years, a fine of $250,000.00, and three (3) years of supervised release following any term of imprisonment.

U. S. Attorney Letten reiterated that the complaint is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.

This investigation was conducted by Special Agents of U.S. Immigration and Customs Enforcement (ICE) and the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF). The prosecution of this case is being handled by Assistant United States Attorney Gregory M. Kennedy.
