NEW ORLEANS MAN INDICTED ON DRUG AND GUN CHARGES
GLENN P. LEVY, age 21, a resident of New Orleans, Louisiana, was charged in a three-count indictment by a Federal Grand Jury for possession with intent to distribute heroin, possession of a firearm by a convicted felon, and use of a firearm in furtherance of a drug trafficking crime, announced U. S. Attorney Jim Letten.
According to court documents, on or about July 17, 2010, LEVY was in possession of Smith & Wesson .40 caliber pistol in the Eastern District of Louisiana. At the same time, LEVY was also in possession with intent to distribute a quantity of heroin and was charged with using the said firearm in furtherance of a drug trafficking crime.
LEVY was previously convicted on or about April 18, 2007 in the 24th Judicial District Court for the Parish of Jefferson, State of Louisiana, for possession with intent to distribute heroin (two counts) and cocaine (one count). As such, LEVY was prohibited by federal law from possessing a firearm.
If convicted, LEVY faces a maximum term of imprisonment of twenty (20) years and a $1,000,000 fine under the heroin count; a maximum term of imprisonment of ten (10) years, and a maximum fine of $250,000 for the felon in possession count and a mandatory term of imprisonment for not less than sixty (60) months and a maximum fine of $250,000 for the use of the firearm in furtherance of a drug trafficking crime in addition to any sentence already imposed by the court. Count 1 is subject to at least three (3) years of supervised release following any term of imprisonment; Count 2 calls for not more than three (3) years of supervised release following any term of imprisonment, and Count 3 calls for not more than five (5) years of supervised release following any term of imprisonment.
U. S. Attorney Letten reiterated that the indictment is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.
The case was investigated by the New Orleans Police Department and the Bureau of Alcohol, Tobacco, Firearms & Explosives and is being prosecuted by Assistant U. S. Attorney Edward J. Rivera of the Violent Crime Unit.
