NEW ORLEANS MAN PLEADS GUILTY TO FEDERAL DRUG DISTRIBUTION AND GUN VIOLATIONS
HERMAN MCMILLAN, aka “Cat Eyes”, age 23, a New Orleans resident, pled guilty today in federal court before U. S. Distict Judge Stanwood R. Duval to a two count bill of information charging conspiracy to distribute 50 grams or more of cocaine base (crack) and for possessing a firearm by a convicted felon, announced U. S. Attorney Jim Letten.
According to the factual basis, MCMILLAN admitted to his role in a conspiracy with co-defendants, KEWAYNE MORGAN, aka “Duke” aka “Shorty” aka “Weezy”, age 26, JOCK WALKER, aka “Tweet” , age 26, EARL JOHNSON, aka “Peter”, age 37, PINKIE BONDS, age 20, and DARRELL PITTS, aka “Darryl Pitts”, aka “Turk”, to possess with intent to distribute 50 grams or more of cocaine base (crack). On February 11, 2009, while executing a search warrant at a residence in the 2400 block of Pauger Street, NOPD officers arrested MCMILLAN and his co-defendants and found approximately 212 grams of marijuana and approximately 29 grams of crack cocaine.
MCMILLAN also admitted that after being released on bond, on March 2, 2009, NOPD officers attempted to stop him as he made an illegal U-turn at the intersection of Baudin and South Pierce Streets. While MCMILLAN attempted to back away from the officers, he reach for a fully loaded Glock 27, .40 caliber semi-automatic handgun and pointed the gun at the officer standing in the front of his car and refused to drop the gun when ordered. The officer fired his weapon through the front windshield and wounded the defendant.
Because of a prior felony drug conviction, MCMILLAN faces a possible maximum sentence of life imprisonment, $8 million in fines and not less than ten (10) years of supervised release for the drug charge; and as to the gun charge, ten (10) years, not more than ten (10) years imprisonment, a $250,000 bond and three (3) years supervised release.
In addition, co-defendant CLARISSA MORGAN, age 23, also a resident of New Orleans pled guilty today to a one count bill of information for Misprision of a Felony. According to the factual basis, MORGAN admitted that she was aware that the co-defendants were participating in a drug distribution conspiracy and allowed them to use her residence to store illegal drugs. MORGAN faces a possible maximum sentence of three (3) years imprisonment, a $250,000.00 fine and three (3) supervised release.
Sentencing for both defendants has been scheduled for August 4, 2010. The five co-defendants are scheduled for trial on May 10, 2010.
The case was investigated by the New Orleans Police Department, the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Orleans Parish Criminal Sheriff’s Office. The case is being prosecuted by Assistant U. S. Attorney Maurice E. Landrieu, Jr.
