INSURANCE COMPANY EXECUTIVES CONVICTION AFFIRMED
Today the Fifth Circuit Court of Appeals affirmed the convictions of BARRY S. SCHEUR, age 51, a resident of Massachusetts, and ROBERT MCMILLAN, age 59, a resident of Texas, announced U.S. Attorney Jim Letten. After a three week trial, SCHEUR and McMILLAN were convicted of conspiracy, wire fraud and mail fraud charges relating to their operation of the now defunct HMO The Oath for Louisiana. The defendants are currently out on bond pending appeal.
BARRY S. SCHEUR, the owner and president of The Oath for Louisiana, was sentenced to 20 months in prison, a $20,000.00 fine, and 2 years of supervised release. ROBERT MCMILLAN, the Chief Financial Officer of the Oath for Louisiana, was sentenced to 13 months in prison, a $13,000.00 fine, and 2 years of supervised release. The Court also ordered that the defendants jointly forfeit approximately $330,000.00 in proceeds received by the defendants as a result their fraud scheme. Co-Defendant RODNEY MOYER, Executive Vice President of The Oath, pleaded guilty to conspiracy prior to trial and testified as a government witness. MOYER has not yet been sentenced.
The case was investigated by the U. S. Postal Inspection Service and the U. S. Department of Labor. The prosecution was handled by Assistant U. S. Attorney Dall Kammer and Department of Justice Trial Attorney Joseph Capone. The appeal was handled by Department of Justice Appellate Attorney Vijay Shanker.
