NEW ORLEANS MAN SENTENCED TO OVER 14 YEARS IN FEDERAL PRISON FOR DISTRIBUTING HEROIN
BRIAN SMITH, age 36, a resident of New Orleans, Louisiana, was sentenced yesterday in federal court by U. S. District Judge Ivan L.R. Lemelle to over 14 years (170 months) in prison for distributing quantities of heroin, announced U. S. Attorney Jim Letten. In addition to the term of imprisonment, Judge Lemelle imposed three (3) years of supervised release following the term of imprisonment, during which time, the defendant will be under federal supervision and risks an additional term of imprisonment should he violate any terms of his supervised release.
According to court documents, on April 26, 2009, SMITH pled guilty admitting that on July 12, 2007, and August 27, 2008, he distributed quantities of heroin in the New Orleans, Louisiana, metropolitan area. Pursuant to the United States Sentencing Commission Guidelines, the Court sentenced SMITH as a career offender due to his having at least two prior felony drug convictions.
The case was investigated by the Drug Enforcement Administration and the Bureau of Alcohol, Tobacco, Firearms and Explosives. The case was prosecuted by Assistant U. S. Attorney Theodore Carter.
