Businessman with Swiss Bank Account Pleads Guilty to Charge of Filing a False Tax Return

Wifredo A. Ferrer, United States Attorney for the Southern District of Florida, John A. DiCicco, Principal Deputy Assistant Attorney General of the Justice Department's Tax Division, and José A. Gonzalez, Special Agent in Charge, Internal Revenue Service, Criminal Investigation Division (IRS-CID), announced that defendant Humberto Gomez, of Miami Lakes, pled guilty today before U.S. District Judge Jose Martinez to a one count Information charging him with filing a false income tax return, in violation of Title 26, United States Code, Section 7206. The violation carries a maximum sentence of three years imprisonment. Sentencing is scheduled for July 23, 2012 at 1:30pm.

According to the Information, defendant Gomez owned and operated businesses that, among other things, sold automobile body parts and stamped metal. In 2004, the defendant allegedly caused the creation of Bullrush Overseas Ltd., a British Virgin Island corporation, and owned and controlled a bank account at UBS AG in the name of Bullrush. Between August 2006 and December 2007, the defendant allegedly made deposits, including business receipts for Venezuelan corporations, in his Swiss UBS account totaling approximately $1,887,859. For 2006 and 2007, the highest balance of assets the defendant owned and controlled offshore at UBS AG in Switzerland was $1,412,026.

For those tax years, 2006 and 2007, the defendant was required to file a United States tax return, to report his worldwide income, and to declare the existence of any foreign based financial account at UBS AG in Switzerland, in which he had an interest and contained assets in excess of $10,000. The defendant filed an individual tax return with the IRS for tax years 2006 and 2007 and willfully failed to report any income earned on his UBS bank account. Additionally, each year, the defendant failed to disclose that he had an interest in or a signature or other authority over a financial account in a foreign country. For the years 2006 and 2007, the criminal tax loss associated with the Bullrush account at UBS is approximately $10,478.

Mr. Ferrer commended the investigative efforts of IRS-CID. This case is being prosecuted by Assistant U.S. Attorney Neil Karadbil.
