JURY CONVICTS PALM CITY BUSINESSMAN OF INTERNET CHILD PORNOGRAPHY CHARGES
Wifredo A. Ferrer, United States Attorney for the Southern District of Florida, James P. Kelly, Chief, Palm Beach County School District Police Department, G. Matthew Immler, Chief, Boynton Beach Police Department, and Robert L. Crowder, Sheriff, Martin County Sheriff’s Office, announced Friday’s (November 18, 2011) conviction of David Frederick Hayden, 53, of Hobe Sound, Florida. Hayden was convicted of receiving child pornography through the internet, in violation of Title 18, United States Code, Sections 2252(a)(2).
Sentencing has been scheduled for February 27, 2012 before U.S. District Judge K. Michael Moore. At sentencing, Hayden faces a mandatory minimum sentence of five years in prison and up to a maximum sentence of twenty years in prison, followed by up to a lifetime of supervised release. In addition, Hayden must register as a sex offender.
During the trial, which lasted five days, members of the South Florida Internet Crimes Against Children Task Force (ICAC) and other law enforcement officers testified that they had downloaded video files depicting child pornography from Hayden’s IP Address through the peer to peer file sharing network while working undercover. A subsequent search of Hayden’s personal and business computers resulted in the discovery of additional images of child pornography, including more than 30 video files in a shared folder labeled X DOWNLOAD on his business computer, which depicted child pornography.
Mr. Ferrer commended the investigative efforts of the Palm Beach County School District Police Department, Boynton Beach Police Department and Martin County Sheriff’s Office for their work on this case. The case was prosecuted by Assistant U.S. Attorney Carmen Lineberger.
