Jeffrey Sloman, United States Attorney for the Southern District of Florida, and Henry Gutierrez, Inspector in Charge, U.S. Postal Inspection Service, Miami Division, announced that defendants Donald Lincks and Kevin Lincks, father and son, of Oakland Park, FL., were sentenced yesterday on charges of aggravated assault on a U.S. Postal Service letter carrier, in violation of Title 18, United States Code, Section 111(a)(1).

U.S. District Judge William Zloch sentenced Donald Lincks to 93 months’ incarceration, to be followed by three years of supervised release. Kevin Lincks was sentenced to 84 months’ incarceration, to be followed by three years of supervised release.

According to evidence presented during the trial, on June 26, 2009, the defendants asked the letter carrier to give them their mail on the street, near their home. The letter carrier replied that, since he did not know the defendants, he could not provide the mail to them on the street. This response angered the defendants, who punched the carrier in the head and face. In self-defense, the letter carrier threw a landscaping rock at the defendants. Kevin Lincks picked up the rock, ran after the carrier, and hit the letter carrier on the shoulder with the rock. The carrier suffered a cut to his right temple, which required medical attention and stitches.

Mr. Sloman commended the U.S. Postal Inspection Service for their work on this investigation and prosecution. This case is being prosecuted by Assistant U.S. Attorney Thomas Lanigan.
