David B. Fein, United States Attorney for the District of Connecticut, today announced that a federal jury in New Haven has found JONATHAN COSGROVE, 27, of Wallingford, guilty of one count of conspiracy to possess with the intent to distribute oxycodone, a Schedule II controlled substance.  The trial before Senior United States District Judge Ellen Bree Burns began on March 20 and the jury returned the verdict yesterday, March 22.

According to the evidence at trial, between August and November 2010, COSGROVE conspired with Raymond Zona and William Fabrizio to pass 18 fraudulent prescriptions, each for 180 oxycodone pills, at a Walgreens in North Haven.  Fabrizio, who was employed as a pharmacy technician at the store, received between $150 and $250 from Cosgrove and Zona each time he filled a fraudulent prescription.

Judge Burns has scheduled sentencing for June 12, 2012, at which time COSGROVE faces a maximum term of imprisonment of 20 years and a fine of up to $1 million.

Zona and Fabrizio have previously pleaded guilty to one count of conspiracy to possess with the intent to distribute oxycodone.  Each awaits sentencing.

This matter is being investigated by the Drug Enforcement Administration and the North Haven, Wallingford and Milford Police Departments.  The Drug Control Division of the Connecticut Department of Consumer Protection and members of the Walgreens Loss Prevention Unit have provided valuable assistance to the investigation.  This case is being prosecuted by Assistant United States Attorneys Sarah Karwan and Vanessa Richards.

In October 2010, the U.S. Attorney’s Office and members of federal, state, and local law enforcement and regulatory agencies initiated “Operation Pharm Team” to combat the misuse of prescription drugs.  Members of Operation Pharm Team include the Drug Enforcement Administration, the Offices of the Inspectors General of the U.S. Department of Health and Human Services and the Department of Veterans Affairs, the Food and Drug Administration, the United States Postal Inspection Service, the Drug Control Division of the Connecticut Department of Consumer Protection, the Medicaid Fraud Control Unit of the Chief State’s Attorney’s Office, the Connecticut Attorney General’s Office, and members of local police departments.
