Fox News Network, LLC v. U.S. Dep't of the Treasury, No. 08-11009, 2010 U.S. Dist. LEXIS 94451 (S.D.N.Y. Sept. 2010) (Maas, Mag. J.). The court notes that the common interest doctrine applies with respect to one email containing legal advice to NYFRB, which was copied to Treasury attorney, because "NYFRB and Treasury shared a common legal interest in having AIG make a proper disclosure to the SEC." As a consequence, "the involvement of . . . a third party to the attorney-client relationship [] does not destroy the privilege because the communications are covered by the common interest doctrine."
