NEOCC Significant Incident Reports

Fiscal Years 1997 and 1998

 


On May 15, 1997, the first District of Columbia inmate arrived at the Northeast Ohio Correctional Center. The following information has been taken from Incident Reports provided to the Corrections Trustee's Office by CCA officials at the Northeast Ohio Correctional Center.

May 1997

Date   Incident   Overview of Incident

May 27 Contraband (Hard) Inmate found in possession of four (4) pair of scissors. One inmate involved. No use of force was necessary.

May 30 Group Disturbance Inmates housed in L & M and E & F Dorms refused to lockdown. SORT Teams were assembled and OC canisters were dropped into the dorms, from the roof portals, to gain control of the living units. No staff or inmate injuries were documented.

June 1997

June 8 Use of Force (Gas) Use of force utilized on inmate due to refusing to obey an order. OC spray was used to gain control of inmate in the North Hallway near Central Control. Inmate was treated by facility medical staff due to the application of pepper mace to his eyes. No staff or other inmate injuries were documented. Incident happened on June 8, 1997, and the date on the medical assessment form indicates it happened on June 14, 1997.

June 16 Assault (Inmate/Staff) Inmate was attempting to assault another inmate when staff intervened. During the course of the intervention, two staff members were assaulted. One was struck in the upper torso, and face with clenched fist and the other officer received a stab wound to the neck. All injuries were superficial. All inmates were brought under control and placed in Segregation.

June 16 Use of Force (Gas) Three (3) inmates refused to obey orders of staff in the Segregation Unit. They continued to throw food trays, trash, and etc. on the range. All three inmates were subjected to pepper mace (gas) and were treated by facility medical staff. No staff or other inmate injuries were noted.

June 18 Use of Force (Gas) Use of force utilized on inmate due to his failure to comply with orders. OC spray was used to gain control of inmate at the West Wing Crash Gate #2. Inmate was treated by facility medical staff and returned to Administrative Detention. No staff or other inmate injuries were documented.

June 20 Assault (Inmate/Inmate) Inmate received three, (3), stab wounds to his person while in Housing Unit CC209. Inmate treated by facility medical staff. No other inmate or staff injuries documented. No use of force was necessary, nor were any inmates identified as assailants.

June 23 Assault (Inmate/Inmate) Inmate received four (4), stab wounds while sleeping in his cell (H-112). Inmate treated by facility medical staff and transported to outside medical facility for further evaluation. No use of force was necessary, nor were any inmates identified as assailants. No staff injuries noted.

June 27 Use of Force (Gas) Use of force utilized on inmate due to disruptive behavior in his cell in Segregation. Inmate was treated by facility medical staff, however, the evaluation report indicates he was treated on July 1, 1997, not the date of the injury. No staff or other inmate injuries were documented.

July 1997

July 01 Assault (Inmate/Inmate) Inmate was discovered in Housing Unit V with two (2) stab wounds in the right lower back area. Inmate was treated by facility medical staff and transported to the local hospital for further treatment. No witnesses to this assault, however one inmate has been identified as the assailant. No staff or other inmate injuries noted.

July 02 Assault (Inmate/Staff) Inmate became abusive with the officer in Unit CC. Inmate refused orders and then struck the officer on the left side of his face. Inmate was restrained and placed in Segregation. No other inmate or staff injuries were noted.

July 03 Use of Force (Gas) Inmate was in the Medical Infirmary and had been placed on Suicide Watch when he was found in possession of a razor blade. He refused to relinquish the razor blade to the officer and was threatening to kill himself or staff. Pepper mace was utilized to gain control of the situation. No staff or other inmate injuries noted.

July 09 Use of Force (Gas) Inmate was in the West Hallway near Central Control, when he assumed a combative position with clinched fists. No actual assault ever transpired. Staff applied chemical agents (pepper mace) to gain control of the inmate. No staff or other inmate injuries were noted.

July 10 Contraband (Hard) A homemade knife (shank) was found in an inmates footlocker in cell W-204. Inmate claimed it was not his but later stated it was for protection. No staff or inmate injuries noted. Inmate placed in Segregation.

July 11 Contraband (Hard) A homemade knife (shank) was discovered in A-Dorm under the Dorm table. This hard contraband could not be attributed to any inmate. No inmate or staff injuries noted.

July 14 Assault, Contraband Inmate was taken to the Infirmary for treatment of possible stab Use of Force wounds but became assaultive when staff attempted to pat search him. Inmate was taken to the floor, searched and a metal weapon was taken from his person. No staff or other inmate injuries documented.

July 14 Use of Force (Gas) Inmate housed in Segregation stated that he wanted to kill himself. When it appeared he swallowing a purple substance, believed to be drain cleaner, pepper mace was used to gain control of the situation.

July 15 Use of Force (Gas) Inmate threw an orange substance on an officer in Segregation. When the inmate was confronted, he placed his mattress in front of the food slot. When the officers opened the door to remove the mattress, the inmate charged them and pepper mace was used to gain control. No staff or other inmate injuries noted.

July 23 Assault (Inmate/Inmate) Inmate was assaulted numerous times while on the Recreation Field. Inmate received numerous stab wounds, abrasions and contusions caused by being struck with a baseball bat, and the feet and fists of his assailants. Inmate was treated by facility medical personnel and transported to a local hospital for further treatment. Inmate identified his assailants. No staff or other inmate injuries were noted.

 

July 25 Use of Force (Gas) Inmate refused an order in the West Wing Hallway. The staff member cleared the hallway of inmates and staff restrained the inmate and escorted him to Segregation. Once inside of Segregation (K-110) the inmate refused to strip for a search and produced a homemade weapon. The inmate was ordered to drop the weapon, and he declined. Pepper mace was used to gain control of the area. The inmate was treated by facility medical personnel due to exposure to chemical agents and placed in Segregation. No staff or other inmate injuries were noted.

July 29 Use of Force (Gas) Inmate refused an order to lay down in his cell so staff could place hard restrains on his wrists. When the officers opened the cell door (F-208) the inmate still refused the orders and pepper mace was used for compliance. Inmate was seen by the facility medical personnel and placed in Segregation. No staff or other inmate injuries were noted.

July 29 Use of Force Inmate refused to lie down in his cell so staff could apply hard restraints on his wrists. Staff then entered cell V-104 and the inmate became combative and force was needed to regain control of the inmate. No staff injuries were noted. The inmate was treated by institution medical staff for abrasions, obtained during the altercation and placed in Segregation.

July 29 Use of Force (Gas) Inmate refused orders given to him by staff. Staff entered cell K-109 and the inmate became verbally aggressive and pepper mace was used to gain control of the inmate. The inmate was treated by medical staff due to exposure to chemical agents and placed in Segregation. No staff injuries were noted.

July 30 Use of Force (Gas) Inmate refused to enter the R&D Intake Cell after being ordered several times. Staff dispensed pepper mace and gained control of the situation. Inmate was treated by institution medical staff due to exposure to chemical agents and placed in Segregation. No staff injuries were documented.

August 1997

August 04 Assault (Inmate/Staff) Inmate struck an officer in the eye with a broom handle. After the Initial incident the inmate became disruptive in the R & D Area and it was necessary to use pepper mace to gain control of the inmate. This incident was referred to the Municipal Court and the inmate was found guilty of felonious assaults. The staff member and the inmate was treated by medical staff for injuries received during this altercation.

August 07 Assault (Inmate/Staff) Inmate assaulted an officer in the sally port of Unit VWX. The inmate struck the officer in the head and other staff responded and subdued the inmate. The inmate and staff members were evaluated and treated by medical staff for injuries sustained during this altercation.

August 19 Use of Force (Gas) Inmate became aggressive during the removal of his handcuffs. Staff responded by spraying pepper mace into the face of the inmate. There were no staff injuries noted and the inmate was treated and placed in Segregation.

August 22 Use of Force Inmate became assaultive and attempted to strike and officer when he was instructed to submit to a pat search. The inmate was given repeated orders to calm down but failed to comply and then attempted to strike one of the officers in the sally port of Pod STU. Responding staff subdued the inmate and he was placed in Segregation. No staff or inmate injuries noted.

August 25 Use of Force Inmate became aggressive in the hallway of the Education Department. The inmate was given several orders to stop walking in the hallway and he refused. When staff approached the inmate, he became assaultive and attempted to strike one of the staff members. Responding staff assisted in gaining control of the inmate by forcing him to the floor and applying restraints. No staff injuries were noted and the inmate was evaluated and treated by medical staff for abrasions.

September 1997

Sept. 14 Use of Force Inmate became disruptive with the Unit Manager during intake screening. The inmate attempted to strike the Unit Manager, but responding staff assisted the Unit Manager in gaining control over the inmate. Three staff and one inmate received treatment for abrasions and contusions by the facility medical staff.

Sept.19 Assault (Inmate/Inmate) Staff discovered an Inmate departing C/D Pod with blood on his shirt. When questioned the inmate stated he fell out of bed. Further investigation discovered the inmate had been assaulted by parties unknown. The inmate was evaluated by institution medical staff and transported to the local hospital for further treatment.

Sept.22 Assault (Inmate/Staff) Staff approached an inmate at the Northwest Wing Crash Gate (Use of Force Gas) and gave him repeated orders to submit to a search. Inmate refused and attempted to strike an officer. Chemical agents were dispersed to gain control of the inmate. The inmate was seen by medical staff and no staff injuries were noted.

 

Sept.22 Assault (Inmate/Staff) Staff were escorting an inmate from a holding cell in R & D when he became disruptive and attempted to strike an officer. Chemical agents were utilized to gain control. Inmate was treated by medical staff and there were no staff injuries noted.

Sept.28 Assault (Inmate/Inmate) Staff responded to a Code Blue Call in T dormitory. Upon arrival they discovered two inmates had assaulted each other. Inmates were treated by facility medical staff and transported to the local hospital for further treatment. No staff injuries were documented.

Sept.28 Assault (Inmate/Inmate) Staff responded to an emergency call to V Pod, cell 108, where they discovered an inmate bleeding from apparent stab wounds. Inmate was treated by facility medical staff and transported to the local hospital for further treatment. No staff injuries were noted.

October 1997

Oct.08 Use of Force (Gas) An unruly inmate attempted to assault the Associate Warden in a holding cell in R & D and force was necessary to gain control of the inmate. Staff applied chemical agents to the inmate's face and restrained him with handcuffs. The inmate was treated for exposure to chemical agents by medical staff and placed in Segregation. No staff injuries were noted.

Oct.13 Use of Force Staff escorted an inmate to R&D for questioning and upon their arrival the inmate became unruly. Staff gave the inmate several orders to submit to a pat search and the inmate refused. Staff members utilized physical force to subdue the inmate and placed him in restrains. The inmate was evaluated by medical staff and placed in Segregation. Inmate claims he was assaulted by the staff during this incident. He also claims he was removed from Segregation and assaulted again by the same officers.

Oct. 17 Assault (Inmate/Inmate) Staff responded to a medical emergency in the Gymnasium and found an inmate with injuries to his facial area, most notably the nose area. Inmate was evaluated by medical staff and transported to local hospital. No witnesses or suspects have been identified.

Oct.20 Assault (Inmate/Staff) Staff responded to the Counselors office on the NW Wing where they heard screaming. When staff arrived, an inmate had the counselor on the floor choking her. The door was locked from the inside and the staff members were unable to get into the area but by banging on the door, the inmate relaxed and the counselor was able to break free and open the door. The inmate was restrained and placed in Segregation. Inmate admits he tried to choke the staff member and criminal charges are pending.

Oct.25 Assault (Inmate/Staff) A staff member issued an order to an inmate to return to his housing unit but the order was refused. The inmate became angry and struck the staff member with his fist. Both parties fell to the floor and the inmate proceeded to bite the staff member, and at that time chemical agents were dispensed to subdue the inmate. The inmate and staff member was treated by medical staff and the inmate placed in Segregation. Inmate claims the staff member assaulted him.

Oct.26 Assault (Inmate/Staff) A staff member was assaulted by an inmate in the sally port entrance of the Inmate Visitation Area. Physical force was utilized to gain control of the inmate, but no chemical agents were utilized. The inmate was removed from the area and taken to Operations wherein the inmate was apparently assaulted by staff. An internal investigation conducted by the facility concluded that excessive use of force was used on the inmate while in the Operations office.

November 1997

Nov.21 Assault (Inmate/Inmate) Staff responded to an emergency call in the North West Hallway where they found an inmate with injuries to the back area. The inmate was treated by facility medical staff and transported to an outside hospital for further treatment of stab wounds. No suspects have been identified.

December 1997

Dec.17 Assault (Inmate/Staff) Two staff members were assaulted in the sally port of U-Pod by two inmates. All parties involved in this incident were treated by institution medical staff. Inmates were placed in Segregation and criminal charges are pending.

Dec.18 Assault (Inmate/Inmate) Staff responded to cell X103 where they discovered a inmate had been assaulted by unknown assailants. The inmate was stabbed in the neck and beaten around the facial area. Inmate treated by medical staff and transported to local hospital for follow up. Three inmates have been identified as the assailants.

Dec.21 Assault (Inmate/Staff) The officer assigned to the sally port of G&H pod was assaulted by an inmate. Responding staff used physical force to restrain the inmate and removed him from the area. The staff member and the inmate involved was treated by institution medical staff.

Dec.21 Assault (Inmate/Inmate) Staff responded to an emergency call in S-Pod Housing Unit where they found an inmate bleeding from stomach wounds. The area was secured and the inmate was transported to the infirmary, where he was stabilized and transported to the outside hospital for surgery. A short time period later, another inmate was found with stab wounds to his upper torso. He was seen by facility medical staff and placed in Segregation.

Dec.31 Inmate Death Staff responded to a medical emergency call to the Medical Isolation Cell #1. Upon their arrival they found an inmate lying on the floor and apparently not breathing. Inmate was transported to the local hospital and was pronounced dead by medical staff. Cause of death was an apparent heart attack.

January 1998

Jan.09 Inmate Rape (Alleged) Staff members were informed by an inmate that he had been raped by another, inmate while two other inmates held him down. Investigation continues by the local authorities.

Jan.21 Assault (Inmate/Inmate) Staff received information from an inmate's wife that her husband had been stabbed. Further investigation revealed the inmate had received numerous puncture wounds to the neck. It appears this could have been in retaliation from the assault on December 21, 1997.

February 1998

Feb.11 Assault (Inmate/Inmate) While feeding the noon meal staff discovered that an assault had taken place in cell #101, B-Pod. It appears three inmates were involved in the apparent assault and no weapons were used. One inmate had numerous contusions of the facial area and a cut lip. All parties concerned were treated by institution medical staff and placed in Segregation.

Feb.12 Assault (Inmate/Staff) During the feeding of the evening meal in S-Pod, an inmate approached the dorm officer and spit in his face. The inmate was upset over not receiving his religious diet.

Feb.20 Use of Force (Gas) While attempting to pat search an inmate in the West Main Hallway the inmate became assaultive and attempted to strike the officer. Responding staff administered chemical agents to gain control of the inmate. The inmate was taken to the infirmary for treatment and then placed in Segregation. No staff injuries were documented.

Feb.22 Inmate Homicide Staff working in Q-Unit was informed that something serious was going on in cell Q-207. Upon their arrival at this cell, they discovered several inmates had assaulted another inmate resulting in his death. All involved inmates were placed in Segregation and the injured inmate was transported to the local hospital where he was pronounced dead by the attending doctor. Cause of death was multiple (12+) stab wounds to his chest and neck area. Investigation and judicial action continues.

Feb.26 Assault (Inmate/Staff) While attempting to clear the hallway near the Northwest Wing Crash Gate, an inmate became volatile and pushed the officer in the chest, knocking him backwards. Responding staff gained control of the inmate and escorted him to Segregation. No chemical agents used.

Feb.26 Assault (Inmate/Staff) While attempting to escort an inmate to his cell he became aggressive and pushed the officer in the chest area with his hands, knocking the officer off balance. Responding staff gained control of the inmate and escorted him to Segregation. No staff injuries were noted and chemical agents were not used.

March 1998

March 08 Assault (Inmate/Inmate) Staff responded to a code blue in P Dorm and discovered two inmates in a physical confrontation. One inmate appeared to be bleeding from apparent stab wounds. Staff intervened and brought the situation under control. Inmates were taken to the infirmary for treatment of wounds inflicted by a homemade shank. No staff injuries were noted. Inmates were removed from GP and placed in Segregation.

March 09 Use of Force (Stun Shield) While attempting to get an inmate moved from one cell to another the inmate became volatile and refused to cuff up. He refused numerous orders to allow staff to restrain him. A cell extraction team was assembled and authorization to utilize the stun shield was given. Staff entered the cell and applied the stun shield, however it did not work, so physical force was used to contain the inmate. The inmate was examined by medical staff and placed in another cell. This incident was not video taped due to the camera not being on hand.

March 11 Inmate Homicide While securing inmates in their cells of the Segregation Unit, staff observed an inmate break free from the officer and started chasing another inmate. The chase ended when another inmate tackled the inmate being chased and the pursuing inmate proceeded to stab the other inmate with a weapon. Staff responded and gained control over the situation. The inmate who was stabbed was removed from the Segregation Unit and transported to the local hospital, where he was pronounced dead by the attending doctor. All other inmates involved were placed in Segregation. This incident is still under investigation by the local authorities. No staff injuries and gas was not used.

The following incidents are related to the Use of Force during the March 1998 situations. The inmates either refused to move, lay down, move away from their windows, etc. and this gave cause to the use of force. The information provided below was taken from Report of Incidents provided by NEOCC.

March 24 Hard Contraband During a routine shakedown to reduce personal property a 10@ weapon was found in an inmate's cell. Inmate was charged with possession of a weapon. No injuries reported.

March 26 Use of Force (Gas/Team) Inmate was instructed by staff not to watch what was going during a shakedown. The inmate was instructed to sit facing the wall and to keep his eyes straight ahead. If he looked back he would be gassed. The inmate failed to comply with the orders and chemical agents were wiped on his face.

March 27 Use of Force Camera not used

March 31 Assault (Inmate/Staff) While making rounds in HH-Pod, the officer was assaulted (hit in the mouth) by an inmate. The officer fell to the floor and a group of other inmates began to kick and punch him. Responding staff utilized chemical agents to gain control of the unit. The staff and inmates involved in this incident were treated by facility medical staff. No major injuries were sustained by staff or inmates.

April 07 Use of Force (Gas) Inmate was instructed to submit to a pat search. He complied; however, he became aggressive and attempted to elbow a staff member in the face. Responding staff members utilized chemical agents to gain control of the inmate. No video camera used.

April 20 Assault(Inmate/Staff) Inmate was ordered three (3) times by staff to walk on the right side of the hallway. The inmate refused the orders and when the officer went to explain to the inmate the rationale for the rule, a confrontation ensued. The officer called the inmate names; the inmate called the staff member names; they shoved each other until responding staff separated them. Inmate placed in Segregation.

May 1998

May 03 Use of Force Inmate was verbally abusive toward a female staff member. Responding staff utilized force to remove the inmate from his cell. The inmate was seen by medical staff and placed in Segregation. No camera use.

June 1998

Date Incident Overview of Incident

June 01 Inmate Death Inmate died while under doctor's care at an outside hospital. The cause of death appears to have been related to long term illness.

June 12 Use of Force Inmate became volatile after his Disciplinary Hearing. Inmate kicked over some chairs and when ordered to stop, he refused and attempted to leave the area. Staff grabbed the inmate, took him to the floor and applied restraints. No staff or inmate injuries noted. No video camera used.

July 1998

July 12 Assault (Inmate/Staff) Inmate was instructed to face the wall for a pat search. He complied with the orders but when the officer attempted to search him, the inmate turned around and hit the officer with his fist. The assault resulted in the officer receiving stitches over the left eye. Responding staff took the inmate to the floor and applied restraints. No inmate injuries were noted. This incident was referred to the local authorities for possible prosecution.

July 13 Use of Force (Gas) Two inmates were ordered to depart their cell during a shakedown. They became verbally abusive and were escorted to the sally port. At that time, both inmates became assaultive toward the staff members and chemical agents were utilized to gain control over the inmates. No staff or inmate injuries were noted.

July 25 Escape Six inmates escaped from the facility by cutting through both perimeter fences. The investigation is still ongoing by the United States Marshals.

July 29 Use of Force Inmate refused to allow medical staff to take a blood sample that was mandated by a court order. Staff responded to the area and used physical force to restrain the inmate while the blood sample was drawn. No staff or inmate injuries were noted. Video camera was used.

August 1998

August 13 Arson Inmate set fire to his cell 212 in the Segregation Unit. Inmate stated he was depressed and attempted to end it all. Inmate was removed from his cell and taken to the infirmary for medical treatment. No injuries noted to staff or inmate. Inmate was returned to the Segregation Unit and placed on Suicide Watch.

August 25 Use of Force (Gas) Inmate became disruptive while attempting to make a legal call. His call was denied due to his negative behavior. Staff members were summoned to assist in moving the inmate back to his cell. Upon their arrival restraints were applied and the inmate was escorted back to his living area. Once inside of the sally port (PP-QQ-RR) the inmate started screaming and falling to the floor in an attempt to injure himself. This continued for sometime until staff could get him secured in his cell. Once in his cell, the inmate refused to let the staff remove his cuffs. They remained on the inmate for approximately another 45 minutes and when they were finally removed the inmate had caused several abrasions on both wrists. No staff injuries noted. Video camera was not used.

August 28 Use of Force (Gas) Staff was dispatched to E & F Pod due to a Code Red. Upon their arrival, they found an inmate assaulting a staff member with his fists. Inmate was given verbal orders to lay on the floor and he refused. Chemical agents were dispensed to gain control over the inmate. Staff and inmate were taken to the Infirmary and treated for injuries. Inmate charged with assault on staff. Video camera not used.

Sept.01 Use of Force (Gas) Inmate became disruptive after a classification hearing. Inmate stated he wanted out of CCA and he would do anything for a law suit. When the inmate was returned to his cell he became hostile toward staff, flooded his cell, blocked his window and became a management problem. Staff was assembled and the inmate was removed from his cell with the use of chemical agents. No staff or inmate injuries noted. This move was video taped.

Sept.04 Inmate Death While staff were making rounds in the Segregation Unit they found a unresponsive inmate in cell 216. Medical staff members were requested and the inmate was removed from the facility to a local hospital. The inmate was pronounced dead by the attending doctor. Autopsy results still pending.
